Driver Distraction and Cell Phone Use: Establishing Liability in Motor Vehicle Collisions and Taking our Medicine


For any victim of a personal injury sustained in a motor vehicle collision, it is crucial to establish the “cause” of the collision in order to establish liability against a driver. In all cases, the personal injury lawyer will seek to establish liability by proving that the defendant driver was inattentive or distracted while driving and was therefore negligent. 1104 Unless negligence is established, there will be no liability found by a Court.

One of the most common causes of motor vehicle collisions is driver inattention and driver distraction. In many cases, when a collision occurs, the responsible driver was momentarily distracted by a wide variety of causes – ranging from talking to passengers, adjusting a radio or air conditioning/heating, sipping their coffee, eating, lighting a cigarette, etc.

With the advent of new technology, the use of cell phones and other electronic devices like blackberries while driving have become a serious traffic safety issue. The danger with using such devices is that the distraction causes a delay in the response time of drivers to critical events on the road, and individuals talking on cell phones have been found to be 18% slower in applying their brakes to avoid collisions.

While there are very few reported decisions in our Courts commenting on or finding negligence as a result of cell phone use by drivers involved in motor vehicle collisions, the dangers created by cell phone use while driving are aptly demonstrated in the decision in Weston v. Regan [2006] A.J. No. 1049 (Alberta Court of Queen's Bench). In that case, the Plaintiff driver was travelling at 130 kilometres per hour on cruise control and was attempting to locate his cell phone that he had dropped when he failed to observe a vehicle ahead and collided with it. The Plaintiff was found 50% at fault, despite the other driver having the duty to yield the right of way. Proof of cell phone use contributing to a collision is difficult, but evidence (or an admission) that a driver was engaged in a conversation at the time of a collision can assist in establishing liability against such a driver.

A recent report on Driver Distraction (by Douglas J. Beirness, Herb M. Simpson, Anita Pak, entitled “The Road Safety Monitor, Driver Distraction” - The Traffic Injury Research Foundation: Ottawa, March 2002) revealed the following:

1 in 5 drivers regularly use a cell phone while operating a motor vehicle;

The risk of a collision is between 3 - 6.5 times higher when a cell phone is being used and there is a 38 percent higher risk if a cell phone is used while driving (compared to those not using cell phones while driving);

the risk of a collision increases the more often you use a cell phone;

Men are considerably more likely than women to use cell phones while driving, and tend to use it for longer periods of time;

Drivers aged 25 to 29 are most likely to use cell phones while driving, and one third of drivers in this age range report doing so;

Drivers who use cell phones tend to be male, younger, live in urban areas, work in jobs that require driving, have higher educational status, drive more, drink more, and are more likely to drive after drinking and to have received a traffic ticket. These are all considered characteristic of high-risk drivers.

The problem of cell phone use and its contribution to motor vehicle collision causation has become widely recognized in the past few years. A number of countries, including the United Kingdom, Australia and much of Europe have also banned using cell phones while driving. Newfoundland and Labrador passed legislation in 2003 banning the use of cell phones, and under Section 176.1 of the Highway Traffic Act, R.S.N.L. 1990, H-3, it is an offence for drivers to use hand-held cell phones. The use of hands-free cell phones is still permitted in that Province.

Doctors Nova Scotia have stated that they are in favour of lobbying the Nova Scotia Government to introduce legislation to ban all cell phone use while driving. The requested ban would apply to both hand-held and headset types of cell phones. The President of Doctors Nova Scotia, Dr. Don Pugsley, has pointed out that the issue is one of distraction and losing focus whilst driving as a result of cell phone use, and not just having one hand occupied by a phone.

Calls to ban cell phone use while driving has generated controversy, with opponents arguing that such proposed laws interfere with individual rights and the Government or groups like Doc5a5tors Nova Scotia have no right to prohibit cell phone use. The arguments are similar to those that arose when mandatory seat belt or helmet use was first considered and introduced. It can be suggested that requiring individuals who wish to place or receive a call on a cell phone, to simply pull over to the side of the road for the duration of the call is not an unreasonable infringement on human liberty, if it avoids a preventable injury or death.

As we know the gorwth of technology across the world will our need to use more good communication is important. I ga to be honest here. I am a big fan of Nokia as the great mobile phones provider. I always had a Nokia phone and would never buy any brand. I bought this phone because of all assessments, the 8gbs, and the video screen. The camera on this phone is great, because its 5MP, but at the same time, since the lens is on the phone you tend to red eyes and if the person you are taking a photo of more than 10feet away, the picture is dark when in a dark room, even when using the flash. The video on this phone is great.

The volume at the top right side of the phone are a bit hard and you do not feel like you are pressing them sometimes. I want this phone has a keyboard. Frankly that's the only thing this phone is missing. I agree with many people who phone is a better way than the iphone because of its web cababilites. Did I mention the games is insane? Yes, it does have N-Gage, but you can go to another site, such as Mosh and get cool nice simple games. Tetris looks so hot on the screen. The GPS on the phone is fantastic! Something not mentioned a lot with this phone is that you can get AM / FM radio on it as well. Each connection can go into the phone as opposed to the iphone which only allows smaller ear pieces. The phone is super loud I hear them 3 rooms away from her rings. Another big advantage is that the phone has flash player and as usual real player. I have to say that for me the standby time may be slightly longer. I've noticed that my nokia 6682 was longer than the N95 8GB, but I do not mind, because this phone is sexy. The buttons are easy to press when you text messages. But again, I just want the phone had a keyboard that I can have a bluetooth a small but why would I use for carrying something extra in my wallet?


This product is also designed to fully protect the phone at the same time you let the phone looks good, because the transparent.Thats.
The down side is, this case will be a tear of the blue form and the crack will take on the 'growing', even if the case is unchanged.
I've used 2 cases and returned both of them.The very last had a crack on the day I opened it the next day by the crack had grown across the front of the phone.This should be asked to cracking itself business.

SPECIFICATIONS

The Nokia N95 8GB is a quadband GSM phone and as his predecessor, it is capable of high speed 3G and HSDPA connections. In terms of design, there is really not much difference, the Nokia N95 8GB retain the slider form function, except that the slider is slightly improved in the earlier version, and it is relatively heavier although you do not really notice the weight. I've noticed that when I compared with the Nokia N95 8GB specs on the old model. It also has a larger screen of 2.8 inches while maintaining its 5 megapixel camera. I think the major difference lies in the fact that the Nokia N95 8GB now has no expansion slot, only the 8GB memory on board.



BENEFITS:

What I liked most is that the Nokia N95 8GB the slider is less susceptible to a shift as a result of the improved slider mechanism. The buttons on the Nokia N95 8GB has also improved with the keys music more forward, so that a more tactile feel. The most notable improvement, however, lies in the large screen. Photographs and videos are now more clear and sharper compared with the earlier model. The removal of the expansion card slot, for me, is a double-edge sword for the Nokia N95 8GB. The advantage of an onboard memory is that you no longer limited to the size of your memory card. You can now do more with your music and videos without an additional memory card.

Disadvantages:

As I said, removing the onboard memory of the Nokia N95 8GB also has disadvantages. Although you no longer limited to the size of your memory card, you are limited to the memory on board 8GB. Although 8GB is spacious enough for some people, it's still not enough for music and movie fans. Some would like to board memory and removable storage so that they can easily files from one device to another, along with advances in technology today, memory cards now has to 16GB capacity and you may miss that extra storage. Another annoying thing about the Nokia N95 8GB is that every time the phone sliding multimedia mode, changes in the landscape mode, but it does not automatically back and you have to do it by hand.

CONCLUSION:

If you have the original N95, the 8GB version is not really a lot to make you want to upgrade, except of course when it really needed a larger screen and onboard memory. For those of you who are considering between the two Nokia N95, it's always fun to have the additional features and the premium of the Nokia N95 8GB on the old model may be worthwhile.

CABinstaller v1.04 For Install CAB in Cellphone



Why a CABinsteller?
Installing a .CAB file is very easy and keeps your PC clean from useless installed files!
Copy the .CAB file to your PPC/PDA/SP (best is to your Memory-Card) and tap on it to install

PPC2000/2002 and WM2003/2003SE users should always use a .CAB installer to be able to choose
where the program they want to install should be installed. If they do not use a CABinstaller, the
program will always install to the default location on their PPC device. Most (but not all) of the
.CAB files can be installed to the Memory-Card, saving precious memory on your device!

Installation Info:
Unrar and copy "CABinstaller.v1.04.exe" to your mem-card. Run it from there.

Some hints:
1- Create a directory on your device's Mem-card and name it CAB-Files. Copy the CAB file(s)
you want to install to this directory.

2- When installing a .CAB file, choose in which directory you want the program to be installed.
In most cases a directory will be created at installation, but there are exceptions! If you
do not want the root of your mem-card to be filled with mixt files, create a new dir and name it
the same as the program you are going to install and choose this dir as your destination.

3- Copying to a memory-card keeps your device's memory free = better and faster performances!

4- If you like, you may choose not to delete the .CAB file after installation (In case you're

In a just-released survey report, ChangeWave takes a close-up look at the features consumers love and hate most about their iPhones and BlackBerrys. This report is a follow-up to a previous ChangeWave Smart Phone survey showing a rapidly evolving two-horse race between the Apple iPhone and the Research in Motion BlackBerry -- with second tier players like Palm and a host of others being pushed to the sidelines.

The previous report showed excellent consumer satisfaction levels for the two top rated smart phone frontrunners -- with Apple sporting a 79% Very Satisfied rating for its iPhone models and RIM grabbing a highly respectable 54% rating for the BlackBerry.

But what is it about these two brands that have consumers so very satisfied?

RIM BlackBerry

The ChangeWave March 2008 survey of 864 smartphone owners found by an overwhelming margin, the feature BlackBerry users like best is its exceptional access to email (56%).

No other feature came close in terms of popularity. As one owner put it, "The email integration of the BlackBerry 8800 is probably its single best feature, but I am constantly amazed at the quality of the phone itself." Another adds "I like the seamless way my BlackBerry works with corporate email and the way you can call a number from within an email by highlighting it."

BlackBerry owners also reported a few key dislikes, number one being the speed and quality of its Internet browsing experience (13%). A second major dislike was the size of the keypad (11%), with owners complaining that the keys are too small and cause too many typing errors.

For example, one respondent states "The overlaid keyboard (two letters per key) and TrueType feature make my BlackBerry slow to type messages without errors."

Apple iPhone

By far the most lauded feature of the Apple iPhone among its owners is the seamless integration of its phone, iPod and Internet browser (36%) capabilities. As one iPhone owner puts it, "The feature I use most is the iPod, but it's the integrated whole that makes it so much fun to use."

Another reports, "I love the iPhone. It is revolutionary. I love being able to jump on the Internet, send email, get maps, weather forecasts, instant message, and make phone calls."

The second most popular feature is the iPhone's touch screen interface, followed by its ease of use.

In terms of dislikes, there is no doubt about what iPhone owners hate most. It's the speed of the AT&T EDGE network. No surprise then that the number two criticism is the requirement to use AT&T. Users also expressed unhappiness with the iPhone's lack of copy & paste functionality.

"According to our survey, both Apple and RIM are in the process of overwhelming the competition," said Tobin Smith, founder of ChangeWave and editor of ChangeWave Investing. "Each has a super-loyal cadre of users that fervently support their brand, and each has extraordinary room to grow."

Smith also points out that previous ChangeWave surveys have picked up a seismic shift occurring among U.S. consumers towards the high end smart phone market. "In simplest terms, that's where the momentum lies," he said.

While the iPhone boasts some of the highest satisfaction ratings ever seen in a ChangeWave survey, the bottom line for BlackBerry owners continues to be -- if it ain't broke, don't fix it. RIM's enormous strength in ChangeWave business user surveys (73% market penetration) strongly suggests they'll maintain momentum in their core market going forward.

For all the iPhone's momentum, there are still some core issues owners want to have resolved -- and first among them is 3G capability. According to the survey, that's the number one feature iPhone owners want integrated into the next generation of the iPhone (19%) -- even more so than third-party software (18%), GPS functionality (15%) or email integration (10%).

The same holds true among respondents who say they are interested in, but haven't yet purchased an iPhone. One-in-four say they are holding out to wait for the next generation iPhone (14%) or for 3G network compatibility (11%).

"The bottom line in this horse race is Apple and Research In Motion are both giant winners, while the rest of the smart phone manufacturers lose," added Smith.

But this trend called platform-as-a-service, or PaaS, could have huge implications. In theory, PaaS makes it far easier for businesses and other enterprises to develop their own applications, instead of licensing or buying the applications from software companies.

The change represents a fundamental disruption to how software gets distributed and consumed, says Paul McNamara, chief executive of small PaaS vendor Coghead. The trend marks "a significant watershed event," he said.
Nearly everything is finding a home on the Internet, and software development is no different.

PaaS can be applied to any market, by any company, according to William Blair & Co. analyst Laura Lederman.

"The emergence of the PaaS offering also represents something more fundamental: a challenge to the way applications are developed and to the vendors that currently dominate software platforms," Lederman wrote in a recent report.

One such dominant software platform is Microsoft's MSFT Windows.

How much of a threat PaaS might be for Microsoft or others is still unclear, but a number of companies are jumping into the fray.

Salesforce.com CRM provides a PaaS, called Force.com.

Force.com is an online hub that customers and partners use to build business software. For example, Electronic Arts ERTS used Force.com to create 14 new applications for managing global recruiting and purchasing.

Other tech vendors have similar types of development platforms. For instance, many view Facebook as a development platform for social networking, while Amazon.com AMZN is a platform for Web sites and e-commerce. Apple AAPL has opened its iPod and iPhone to outside developers.

The PaaS trend is especially hot in business software. A host of small, privately held companies have Web-based development platforms, in addition to their own software that they license to users. These companies include Archer Technologies, Bungee Labs, LongJump and Coghead, whose investors include No. 1 business software maker SAP SAP.

By offering software platforms, these Web-based firms can grow "far beyond the scope of the current application they offer," Lederman wrote.

For instance, Archer makes software to manage corporate risk and compliance. It recently launched a PaaS that lets outsiders write and share new applications on its SmartSuite development framework. So far, 60 new applications have been built for the exchange, says Archer Technologies CEO Jon Darbyshire.

"People use the framework to build so many things that it's the hottest part of our company right now," he said.

Clients pay an annual license fee of $8,000 for unlimited access to SmartSuite and all other applications on the Archer exchange.

Even nontechies can build applications with SmartSuite, he insists. The platform lets users compile software functions by simply dragging and dropping software modules they want to use.

"This approach is taking off because it puts control back in the hands of business people, so they don't have to wait around for software developers," Darbyshire said. "Our view is that this is going to be very disruptive to the market because it forces traditional software companies to rethink their delivery model."

Coghead runs its entire business and development platform on computer systems hosted by Amazon. This is an example of a parallel trend known as cloud computing, in which applications are hosted on external servers. Users access the software via the Web.

"Our platform allows you to do away with managing networks, security, databases and computer infrastructure," said Coghead's McNamara. "All that is really complicated."
